un m\u00e9dico u otro profesional de la medicina no cumple las normas de asistencia en el desempe\u00f1o de sus funciones, con el consiguiente perjuicio para el paciente, \u00e9ste o su familia pueden tener derecho a una indemnizaci\u00f3n mediante una demanda por negligencia m\u00e9dica. En tal caso, debes hablar con un abogado experto sobre la posibilidad de presentar una demanda.<\/p>\n<h2>Requisitos generales<\/h2>\n<p>En todos los casos de mala praxis, deben cumplirse determinados criterios antes de que tengas un caso procesable. Entre ellas est\u00e1n:<\/p>\n<ul>\n<li>La existencia de una relaci\u00f3n de cuidados. El paso inicial para establecer una negligencia es demostrar que exist\u00eda una relaci\u00f3n m\u00e9dico-paciente en el momento en que se produjo la lesi\u00f3n del paciente. S\u00f3lo los m\u00e9dicos o profesionales de la medicina que participen activamente en el diagn\u00f3stico o tratamiento de un paciente pueden ser responsables de <a href=\"https:\/\/www.hg.org\/medical-malpractice.html\" target=\"_blank\" rel=\"noopener\">negligencia m\u00e9dica<\/a>.<\/li>\n<li>La negligencia m\u00e9dica es demostrable. Una mala experiencia no basta por s\u00ed sola para justificar una demanda por negligencia profesional. Para que se establezca una reclamaci\u00f3n, debe probarse que el paciente sufri\u00f3 da\u00f1os a causa de un tratamiento que no cumpl\u00eda la norma de asistencia. Por tanto, si la atenci\u00f3n prestada no se ajust\u00f3 a la norma de atenci\u00f3n, puede ser posible una demanda por negligencia profesional. En general, un profesional del sector debe establecer una norma de atenci\u00f3n m\u00e9dica, y el demandante y su abogado deben demostrar c\u00f3mo se desvi\u00f3 el m\u00e9dico de esa norma.<\/li>\n<li>Lesiones derivadas de negligencia m\u00e9dica. Los implicados en demandas por negligencia suelen estar enfermos cuando visitan al m\u00e9dico, por lo que debe demostrarse que las acciones del m\u00e9dico, y no su estado, causaron el da\u00f1o. Esto suele establecerse consultando a otro m\u00e9dico para determinar si la falta de atenci\u00f3n m\u00e9dica adecuada caus\u00f3 la lesi\u00f3n en cuesti\u00f3n factor causal de la lesi\u00f3n.<\/li>\n<li>Se produjeron da\u00f1os como consecuencia de la lesi\u00f3n. Aunque se cumplan todos los criterios anteriores, debe establecerse que el paciente sufri\u00f3 da\u00f1os y perjuicios reales como consecuencia del incumplimiento de la norma de asistencia por parte del m\u00e9dico. A menudo esto puede adoptar la forma de dolor f\u00edsico, p\u00e9rdida de salario debido a la lesi\u00f3n, dolor emocional o mental, y los consiguientes gastos m\u00e9dicos adicionales.<\/li>\n<\/ul>\n\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t<div class=\"elementor-column elementor-col-50 elementor-top-column elementor-element
